Evaluation on Ban of Cosmetic Tail Docking for Dogs

The Prevention of Cruelty to Animals Act 1979 states, that in section 11(2A), that tail docking is prohibited unless performed by a veterinary surgeon in the interests of a dog's welfare. An evaluation of that prohibition, which commenced on 1 June is now being carried out by the NSW Department of Primary Industries, Animal Welfare. Requests for submissions will be sent to all veterinary clinics and hospitals in NSW.

Information presented in submissions should relate to breeds of dogs in NSW that were previously docked, and should indicate whether the welfare of these dogs has, or has not been, adversely affected by the ban on tail docking.

Submissions should provide objective information where possible such as veterinary statements and reports, other verifiable documentation or photographic material. The data provided should provide statistical analysis of the incidence of welfare problems, for example, the number of animals affected, litters born etc.

Please note that follow-up information relating to individual dogs may be sought with the permission of the person who made the submission and other affected individuals.

Submissions should be sent to:
Mr Ross Burton
Animal Welfare Branch
NSW Dept of Primary Industries
Locked Bag 21
ORANGE NSW 2800

The closing date for submissions is 30 November 2005.

Section 14 of the Veterinary Practice Act 2003 -
corporations and firms owning veterinary practices
Section 14 of the Veterinary Practice Act 2003 relates to corporations and firms owning veterinary practices and on the 9 May 2005, S14 commenced.

In summary, a company can own a veterinary practice if one or more veterinary practitioners (registered veterinary surgeon/s) has or have a controlling interest in the company.

Also, a corporation or firm that provides veterinary services but whose principal business is the supply of goods or materials used in connection with agriculture so long as the provision of the veterinary services is at the same premises from which those goods and materials are supplied can also own a veterinary practice.

It must be noted that agriculture is meant to mean companies that typically supply farm products such as agricultural and veterinary chemical products. The intention of the legislation is not to mean other companies such as pet supply businesses.

Until the regulations have commenced, any company wishing to own a veterinary practice must still comply with the existing Veterinary Surgeons Act and Regulations and this includes either a class A, B or C veterinary hospital.

Veterinary Practice Act, 2003 - part effective!!

On the 9 May 2005 some parts of the Veterinary Practice Act 2003 were gazetted and have now commenced. Sections 11, 12, 14 (corporations and firms owning veterinary practices), 15, 91, 99, 100, 102, and 103 and Part 1 of schedule 4, and Section 106 in its application to that part have commenced. However, these sections make up only 1/10th of the Act and the remaining sections have not yet been proclaimed due to the wait for the required complementary regulations.
Staff of the Minister for NSW Department of Primary Industries (DPI), have been in contact with the Board to inform that the anticipated regulations to the Veterinary Practice Act 2003, are currently being developed but that it may be up to a year before all the necessary work is completed.
